§ 98-629. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Abandoned vehicle means any motor vehicle or trailer which has been left in the public streets or in any public place, or on public property, or on any private real property, without the consent of the owner or occupant in possession of such property, and:

    (1)

    The vehicle shall be deemed to be left without consent where no arrangements have been made for its storage with the owner or occupant of the premises on which it is located.

    (2)

    Abandonment will exist where the owner has indicated by his words or actions an intent to leave the vehicle and no longer claim ownership thereof.
