§ 94-33. Procedure for approval of plats.

  • (a)

    Whenever the owner of any tract or parcel of land within the city wishes to subdivide or to make a subdivision of the same, he shall have said land platted in the following manner:

    (1)

    He shall confer with the city clerk or his assistants in order to become thoroughly familiar with the city's regulations and requirements affecting the territory in which the land in question lies and shall obtain copies of all provisions of this Code and city ordinances pertaining to procedure and requirements for subdivision of land and shall pay a fee of $500.00, plus $100.00 for each potential lot in excess of three, to the city by depositing the same with the city clerk. This fee is provided to defray the costs incurred by the city in the processing of applications for the approval of subdivision plats.

    (2)

    He shall prepare and submit to the city plan engineer a rough preliminary plat of the proposed subdivision and procure his recommendation regarding the general requirements and the design of the subdivision.

    (3)

    Thereafter, he shall prepare a preliminary plan drawn to scale of not less than one inch to 100 feet showing:

    a.

    The topography of the land;

    b.

    The location of the proposed streets;

    c.

    The lot lines and building lines;

    d.

    The total number of square feet in each lot in such plat exclusive of any and all road easements on the platted property, with the accuracy of such figures duly certified to on such plat by a licensed surveyor having offices in the county;

    e.

    The surrounding streets, lots, watercourses, sewers and water mains;

    f.

    The location of all existing buildings and structures on the lots covered by such plat.

    A copy of such plat shall be provided for the street commissioner, city plan engineer and the sanitary and surface water engineers.

    (4)

    When the preliminary plat is submitted the subdivider shall also submit studies and plans for the proper disposal of stormwater and sanitary sewage within all portions of the subdivision. Such plans shall show the location of all sanitary sewers or proposed sanitary sewers in the subdivision, and shall show the location of open surface water drainage channels, together with information regarding any necessary widening, straightening, surfacing or other improvements of such channels, as well as similar data regarding the location, size and type of construction of any culverts, bridges or underground facilities for disposing of either stormwater or sanitary sewage. Data regarding the area served by the facilities, the estimated volume of runoff and other similar information shall accompany the plans. Any easements necessary to accommodate the sewers or stormwater drains or underground construction shall be provided on the plat and the subdivider shall also give satisfactory assurance to the council that the improvements necessary to accommodate the disposal of both stormwater and sanitary sewage shall be made.

    (5)

    Such preliminary plats shall be approved or rejected by the respective city representatives mentioned in subsection (a)(3) of this section within 30 days of the date they respectively receive such preliminary plats; and if either of such city representatives fails to act thereon within such 30-day period, the preliminary plat shall be deemed to be approved by such representative of the city.

    (6)

    The respective city representatives mentioned in subsection (a)(3) of this section shall indicate their approval of such preliminary plat by placing their initials thereon, and after all such approvals have been obtained the preliminary plat shall be delivered by the subdivider to the city's zoning and planning commission for their consideration and action. The city's zoning and planning commission shall study such preliminary plat to see if it conforms with the minimum standards and requirements of the ordinances of the city and applicable provisions of this Code, and shall approve or reject such plat within 60 days after the date of submission thereof to the commission. If the commission does not act within such period of time the preliminary plat shall be deemed to be approved, but such approval does not constitute approval of the subdivision, but merely an authorization to proceed with the preparation of the final plat.

    (7)

    The subdivider shall then submit to the city's city plan engineer, the street commissioner and the sanitary and surface water engineer respectively a final plat of the subdivision consisting of a final map on tracing cloth and three prints thereof showing:

    a.

    The boundaries of the property; the lines of all proposed streets and alleys with their widths and names; and any other property intended to be dedicated to public use.

    b.

    The lines of adjoining streets and alleys, with their widths and names.

    c.

    All lot lines, building lines, and easements with figures showing their dimensions.

    d.

    All dimensions, both linear and angular, necessary for locating boundaries of the subdivided area of the lots, streets, alleys, easements and building line setbacks, and any other similar public or private uses. The linear dimensions shall be expressed in feet and decimals of a foot.

    e.

    Radii, arcs and chords, points of tangency, central angles for all curvilinear streets, and radii for all rounded corners.

    f.

    All monuments together with their descriptions.

    g.

    Title and description of property to be subdivided, showing its location and extent, points of compass, scale of plan, and name of subdivider and of engineer staking the lots.

    h.

    Profiles may be required of any streets.

    i.

    Any private restrictions shall be shown on the plat or reference made to them thereon, and plats shall contain proper acknowledgments of owners and mortgages accepting said platting and restrictions.

    j.

    A certificate shall accompany the final plat showing that all taxes due shall have been previously paid.

    k.

    There shall also be submitted, in triplicate, detailed plans of the sanitary sewer and stormwater facilities which are to be constructed in the development of the proposed subdivision.

    (8)

    The same procedure shall be followed with respect to said final plat as is specified in this section with respect to the preliminary plat, including the provisions with respect to time within which such plat shall be approved, and after such final plat has been approved by the zoning and planning commission they shall initial or sign a copy of such final plat and deliver to the city clerk's office said original tracing and a copy thereof, together with a letter indicating their approval thereof.

    (9)

    At the first meeting of the city council thereafter such final plat shall be presented to the city council for its approval or rejection.

    (b)

    If the zoning and planning commission does not approve the final plat of the subdivision, the city council may approve said plat only by a two-thirds vote of the membership of the council. Two copies of all final plats shall be filed in the office of the city clerk after approval by the city council.
