§ 22-6. Declaration of state of emergency.

  • In the event of a disaster involving imminent peril to lives and property in the city, the mayor may declare that a state of emergency exists in the city and may exercise during the actual existence of such emergency the power to enforce all rules and regulations relating to emergency management and disaster operations and act under the authority of current ordinances of the city, current statutes of the state and the applicable section of the United States Code Annotated; and may also take control of any means of transportation and communications, any facilities, including buildings and plants, and to exercise all powers necessary to secure the safety and protection of the general population. In exercising such powers the mayor shall be guided by the regulations and laws and orders issued by the federal government, the state and the county relating to disaster operations and shall take no action contrary to orders issued by the governor under similar emergency powers.
