§ 14-10. Public consumption or sale of alcohol.

  • (a)

    Sale of intoxicating liquor near public streets . No person shall sell, either from a vehicle or otherwise, any intoxicating liquors as defined herein, upon any public street, highway or thoroughfare, sidewalk or alley, or within 15 feet from either side thereof, within the city.

    (b)

    Consumption of alcoholic beverages on private property available for public access and in public areas . No person shall consume any beverage containing alcohol, in any percent, either by weight or by volume, while on private property which is available for public access, any public building, while on private or public parking lots and sidewalk areas which are adjacent to public buildings, or any streets or public walkways within the city.

    (c)

    Consumption and sale of alcoholic beverages may be authorized in conjunction with a special event. Notwithstanding subsections (a) and (b), sale of intoxicating liquor near public streets and consumption of alcoholic beverages on private property available for public access and in public areas shall be permitted by special use permit issued by the city or for special events sponsored by the city in accordance with Ordinance No. 1175 when such sale or consumption is otherwise in compliance with this chapter and state and county liquor laws and all required liquor licenses have been obtained.
